Dude, there's a huge difference between using something for free, and selling it for profit. I don't know about Mexico, but here that's illegal.

Guess not. Though apparently SonyBMG isn't too happy about them using an unapproved picture either.

Here is Hyrus' explanation of the law (he's from Mexico). I agree with him that it's total BS.

There’s a little notice that Mina Editores put on the last page that says the following: “All the images used in this issue belong to their respective copyright holders and have only been used with informative purposes”.

That is their excuse for using any image they want and to pretend not to be making any profit from the images, but for the information posted on the magazine. Obviously this is BS cause the info actually sucks and the main reason for buying the magazine are the posters it includes. However, that notice --here in Mexico-- is enough to protect the editors and ignore any person who might complain about it. I know it’s unacceptable but that is the cold and harsh reality.

So they can get away with it, but that doesn't make it right. The magazine was supposedly worked on with fans. Didn't anyone think to even just ask the photographer? This is why RMJ now makes sure to clearly watermark.

I doubt that this is legal in Mexico. Anyway, he can go on and start something in the courts, if he is sure that he will win and make a lot of money out of it.

tho Hyrus is right.. its BS.
