yeah thanks, I feel bad for the driver, I hope his insurance covers it because I dont think it was really his fault. He made sharp turn coming around the corner and he just tipped over

It was absolutely his fault. When you're driving a vehicle, any vehicle, you are obligated to understand what its limits are. When you're driving a truck (which has that much more capability to do damage), you have to be even more careful driving.

This driver made a sharp turn around the corner, and being the driver of the truck, he should have known that the truck was unable to make that turn. He is at fault for the damage.

His insurance will cover it, but he'll pay in the long run.

but Arden ave. is a major avenue and its not his fault that its a dangerous intersection and a sharp corner.

There are plenty of dangerous intersections and sharp corners in many cities, though; if the driver had even a shade of a doubt that he could make the turn, then he shouldn't have made the turn. If he didn't know, then he shouldn't be driving trucks.

damn! some luck you got.

how fast was the dude going? if he was going too fast, of course its his fault. anything with that amount crap in the back is going to be top heavy, and can easily tip over.

he wasn't going that fast (probably 20-30mph), his truck was wobbling after the turn, I thought it would stay up but no it tipped over. Come to think of it I always see trucks wobble coming out of that turn, this is the first 1 I saw tip though

Sometimes loads shift in trucks unexpectedly (usually after a turn, merge or lane change) and they tip over sometimes. I'm just saying...

But 20-30 mph is a little fast to take a tight turn in a truck.

glad you're ok FRA

well it's probably the driver's fault but the law student inside me wants to look for alternatives

1. there were mechanical defects with the truck/trailer and its his employer's obiligation to do routine maintenance on the truck/trailer

2. there was a pothole or some type of defect with the surface of the road which caused the trailer to tip

3. the drive didn't have adequate training for driving the trailer and if employed by someone its the employer's obiligation to make sure all his employee's are well trained and licensed

4. signs on the road are poorly designed - the speed limit listed inaccurately represents how fast one should be going...etc.

5. another car cut off the truck driver suddenly causing the truck driver to turn suddenly

6. a pedestrian cut off the truck driver suddenly...

that's all i can think of so far

but all in all it was still probably the driver's fault although there may be mitigating factors

glad you're still with us FRA! AAm wouldn't be the same w/o you!
